This article is first and foremost a personal tribute to my dear friend and former colleague, Vincent de Gaetano, and at this point it is imperative to disclose the interaction of the personal/judicial and the scholarly perspectives. When Ladele was decided, I congratulated Vincent and Judge Nebojša Vucinic on their dissenting opinion which reflected a principle that is crucial to liberalism as tolerance: “no one should be forced to act against one’s conscience or be penalised for refusing to act against one’s conscience.” The state shall not force someone to choose between the imperatives of her (religious or other) conscience and livelihood. Certainly not, where there are less burdensome alternatives (accommodation).
