Az Alkotmánybíróság egyedi ügyeket érintô alapjogi gyakorlatáról

"Bár az eljáró bíróság kezdeményezése és az alkotmányjogi panasz az egyedi jogérvényesítést szolgálja az Alkotmánybíróság eljárásában, számos absztrakt indítvány kapcsolódik egyedi ügyhöz, csak éppen nem alkotmányjogi panaszként terjesztik elő, illetve az indítvány csak formailag irányul normakontrollra. Az Alkotmánybíróság alapjogi joggyakorlatában előfordulnak olyan esetek, amikor az alkotmánybírák az absztrakt normakontroll égisze alatt egyedi ügyeket érdemben, vagy szinte közvetlenül meghatározó döntéseket hoznak. Az alkotmányjogi panaszt, az eljáró bíróság kezdeményezését és az absztrakt kontroll eljárásában feltűnő konkrét jogviszonyokat vizsgálva átfogó kép rajzolható az Alkotmánybíróság egyedi ügyeket érintő alapjogi gyakorlatáról."
