The breakneck pace of progress in the field confronts lawyers and policymakers with the question of how to fit new technologies within pre-existing legal frameworks. How can we regulate the digital economy to maximize its benefits and ensure fair distributive outcomes? How can the collection and analysis of personal data for business and surveillance be reconciled with the protection of privacy and the protection of sensitive information? Can and should the Internet be subject to national regulation despite its global and borderless reach? These are but a few of the questions that the law will need to address if it is to remain relevant in an ever-changing environment. This course seeks to provide students with critical knowledge of a selected number of issues that arise from the interplay between law and technology. Students will be exposed to key debates in areas such as Internet governance, e-commerce, data protection, freedom of expression in the digital space, artificial intelligence, blockchain-based transactions, and cryptocurrencies. Whenever feasible, the course will compare the different regulatory frameworks of the world's major jurisdictions. Since the European Union and the United States are the two most significant systems that set global legal standards, their legal orders will be used as the main point of reference.
