Aim & Background

BRIEF INTRODUCTION: This course offers a dive into constitutionalism in Latin American countries, its common features and its differences. We will particularly explore the features traditionally identified as distinctive of constitutional developments in the region, especially with regard to their transformative proposal in relation to colonial and authoritarian pasts. Further, we will analyze the relations between powers with special emphasis on the traditional protagonism of presidentialist executives and the ascendant role of the judiciary, especially in guaranteeing rights. Finally, we will also explore a range of substantive topics, particularly areas in which the region has offered contributions to the global debate such as indigenous, environmental, socio-economic, and other. GOALS: Students will be encouraged to reflect on the existence of a Latin American constitutionalism or the multiplicity of constitutionalisms in the region. In addition, they will gain insight into relevant features of constitutional and rights development in Latin America. Finally, they will be invited to reflect on the extent to which these elements can contribute to the global debate on constitutionalism and rights.
