The course will trace political and intellectual developments that enabled the translation of claims concerning individual liberties and human rights into legal documents, and explore the contradictions in human rights discourse and practice over time. The evolution of consecutive generations of rights will be examined and challenged alongside the development of national, regional and international mechanisms for their protection. The aim is to provide insight to the development of legal rules, their subsequent application as well as to the outcomes they produce. Classic legal problems and contemporary challenges are introduced through case studies. The course will provide ample opportunity for students to reflect on the consequences of competing intellectual frames on human rights for their protection as legal rights.
